This is one of several resolutions I will be proposing at the Texas GOP Convention.
Whereas, the act of torture is in violation of the Geneva Convention Article 3, Section 1a which forbids “Violence to life and person, in particular murder of all kinds, mutilation, cruel treatment and torture;” and
Whereas, the act of torture is in violation of the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment of which Article 2, Section 2 reads “No exceptional circumstances whatsoever, whether a state of war or a threat of war, internal political instability or any other public emergency, may be invoked as a justification of torture;” and
Whereas, the act of torture used as a tool to compel a confession is in violation of the Fifth Amendment right against self-incrimination; and
Whereas, the act of torture used as a tool to compel a confession is in violation of the Miranda right to remain silent; and
Whereas, the act of torture is in violation of the Eighth Amendment right against cruel and unusual punishment; and
Whereas, the act of torture is in violation of U.S. Code Title 18, Part 1, Chapter 113C which forbids “the intentional infliction or threatened infliction of severe physical pain or suffering;” and
Whereas, the act of torture goes against the unalienable rights of life, liberty and the pursuit of happiness; and
Whereas, the act of torture is known to produce unreliable intelligence;
Therefore be it resolved that we, the Republican Party of Texas, firmly oppose the use of torture in any and all circumstances.
